1. I believe one of the things that is unclear is what truly does exclude someone from playing advanced. Some people who have won several intermediate tournaments have been allowed to keep playing intermediate. So how well you play or your results don't seem to matter (at least in the US). What seems to matter is whatever the tournament director decides.

2. Does it matter what level you play against? Aren't your error ratings based strictly on the plays you make, regardless of the plays your opponent makes?

3. Since there are no definitive skill level standards, and the rule pretty much permit anyone to play intermediate or advanced divisions until forced to move up by the director, there is no definitive way to answer your question. I believe it is possible to play at 3.5 and play intermediate if you have no major tournament wins.
