I thought the usual place that the rule is invoked is for an incorrect setup of the checkers for the initial position.

Now here is another possible problem. Player B condones the illegal play by just rolling. Later in the game player A has a choice to run or stay for a last ditch shot. Not fearing the bg A stays. B rolls doubles and claims a backgammon. A does not remember correctly the position from when the checker was borne off illegally. What can be used? A recording of the match either by hand or video should be enough, but what about eyewitness testimony?
