You're right, the way I put it the action of the cheating player would not be accepted by a TD. However, you can add other distracting circumstances to such a situation and make the offending player's illegal play less obviously illegal. At some point a premature cube action can tip the scales in favor of the cheating player when a ruling needs to be made. And of course, best solution (again) is to use clocks.
