This is a matter for the director's judgment. The director can call it a cube, or he can simply warn the player to refrain from capricious cube handling in the future. If I were on the appeals committee I would uphold either ruling.
The purpose of the penalty, in my opinion, is to penalize intentional gamesmanship with the cube. If the director doesn't believe Player A was making any effort to gain extra information, I have no problem with him issuing a warning for the first offense. The rule as written is already a sufficient deterrent for intentional misconduct.
