"This is a matter for the director's judgment. The director can call it a cube, or he can simply warn the player to refrain from capricious cube handling in the future. If I were on the appeals committee I would uphold either ruling."

I agree with you, but I will add that the director should also take into account the experience and level of the player and whether they should "know better". As far as I am concerned, any player at the Open level who touches the cube should not receive a warning, whether or not they had intent for gamesmanship. They should simply know at that level that it is not done and if you do, you live with the consequences. Period.
