Hold on. What are you claiming here? When you say "that's what they did argue" who are "they"? Sounds like Feist, since they were the ones who were consolidating rural phone books. But Feist won at the U.S. Supreme Court level. The argument that lost was Rural's argument that they spent a lot of effort compiling their phone book.

Creative choice won the day in this case.
