5.6 DEAD CUBE. When the cube level is high enough to ensure that the match will end with the current game, that game shall be played to conclusion at the present cube level.

This is from the US 2009 rules. It would seem to be specific enough that the answer to your questions are, no the cube is not yet dead (because the requirements of the DEAD CUBE rules have not yet been met), and yes it can be taken at 4 by the trailer and re whipped to 8.
