I think it is strange to worry about a player being penalized time wise without also worrying about being penalized equity wise.

If you go the route (and actually even if you don't) of considering players that purposefully make illegal moves then the current illegal moves rule also makes no sense. Because as is, a player can purposely make a beneficial illegal move at no risk to himself. If he gets caught no harm is done to his equity and if he gets away with it then it was the opponent who suffered.
