Unfortunately, those arguing the New Jersey case back in 1978 did not have the wisdom to argue the point, and the benefit of modern computer simulations that can show conclusively that the chance of a player with zero skill (random) defeating a player with high skill (bot) in an 11 point match is by all practical measures zero to many decimal places. There is no material contribution of the element of chance to this outcome. The fact that basic skill is obtained easily by players learning backgammon and greatly levels the playing field against top players does not change the fact that it is learned skill that is responsible for equalizing things, not increased chance.
