It is obvious to me that luck is not the "dominant factor" in backgammon. It is also obvious to me that luck is a "material factor" in backgammon.

These conclusions might not be as obvious to a court, but I would expect any reasonable judge to agree after hearing competent expert testimony. Maybe I could be the expert, since it tends to pay better than lawyering.

Sometimes the outcome of a court case hinges upon the judge you happen to draw. Is litigation a game of chance?
