Legal plays??

In poker if you didn't have the rules the way they are someone could purposely bet out of turn leading you to think they were going to bet. In other words, if they weren't forced to commit to their out of turn action they could act out of turn to gain an advantage.
But isn't the same true for backgammon? Someone could make an illegal play in purpose to gain an advantage. That's why there is a rule which you can use to force these plays to stand.
To me these situations seem basically the same.
Also not true for the poker scenario I gave. The suitable rule would be if the dealer isn't sure if someone saw the card or not then the dealer reshuffles, how easy of a rule is that?
I think the reason that the judging by the players works in this situation is, that a player who saw the face of a card is never sure if other players noticed that he did.
I'm not saying that all players would take advantage of the situation if they were sure nobody noticed them. Probably 90% wouldn't. But that 10% is why rules exist.
