The rule Rob refers to is: Checkers which have been borne off must be kept off the entire playing surface for the rest of the game.

That's nice and all but the checker wasn't borne off, it was put on the bar. To me you and Rob are trying to force the checker to be borne off because you know that's the way it should be. I agree with you, of course it should be considered borne off. Per the rules though I don't believe you have a case unless you implement rule 1.1.
