He can try that, sure. As long as there was no dispute about what the roll was, I wouldn't expect a director to have much trouble figuring out which player conceded.

That said, a player who picks up the dice in this situation without first getting a resignation or at least some sort of acknowledgment from the opponent is foolish and deserves some measure of blame for any adverse ruling he might get. After all, the opponent might claim he saw a 2-1.
