I still think it's the wrong solution to a valid problem.
The proper way to enforce this would be to have the players start a 5 minute countdown when they go on brake. Once that countdown has ended, any player back at the table can start the opponents time if he's not there.
That would be fair. You get your 5 minute breaks, it you take longer it's from your playing time.
On the other hand there are no speculation in when to take breaks - and there are no players that can skip breaks to play dreadfully slow (forcing their opponent to sit and watch the slow play BTW - so you can't say that it is "fine" if they elect to turn their breaks into play-time - it's not - I'd not like to be forced to sit and look at the table for 10 minutes while my opponent decides on his opening 3-1).
I hope you understand my point. There simply must be better ways to control this.
