In this instance, I am asserting is that the particular transcription made on our behalf, for purposes of posting on our site, cannot be replicated as presented on our site, because of trademark rights.
Trademark rights? Or did you mean copyright?
Isn't the key phrase there "cannot be replicated as presented on our site"? I imagine USBGF has some rights with regard to presentation, i.e., the web page containing the match transcript, but I do not believe that USBGF (or anyone) can successfully assert any copyright whatsoever in the data (the list of moves and match-identifying information) of the transcript itself. Which means that anyone is free to make a transcript from a USBGF-provided streaming video, or make a transcript from a USBGF-provided transcript.
Obviously, it takes time to make a transcript of a match. But I don't believe that has any relevance to whether a transcript is a creative work that can be copyrighted.
The offputting features of the agreement that Bill posted were that it seemed to mean that someone who volunteered to transcribe one of your videos (a) could not also, for example, upload a copy of the transcript to Othello's match archive without permission from USBGF and the players (b) because USBGF has a copyright in the transcript. I don't think (a) is good policy -- I would never agree to that -- and I don't think (b) is true.
