I don't think this situation is the same as legal-vs-nonlegal moves issue in backgammon.

In backgammon if you realize you have made an illegal move, you should point it out immediately. This applies whether you are playing legal moves or not. If you allow your own illegal move to stand, this is almost the same as intentionally making an illegal move. I think everyone agrees that intentionally making an illegal move is cheating, no matter what ruleset you are using.
