I may be wrong, but I seem to recall looking at the resignation code quite a long time ago and I think that to favour speed (my guess) resignations may be done at a lower ply (maybe even 0 or 1 ply?) than what is being played at. I remember looking into an issue that the resident ogre at RGB (the one with a bridge to sell) found. It was an inconsistency when resignations were being offered.

The resignation level could be changed (assuming what I remember is correct) but one would have to look at the cost in performance (maybe it isn't even an issue)
