Creating penalties for illegal moves reduces the burden on a player to be constantly vigilant against an unscrupulous or careless opponent...this is a good thing.

The fact that there exist other methods (i.e. checker shuffling) that also require a high level of vigilance to monitor takes nothing away from the initial claim. If anything, it highlights the need for better rules around such situations...which is something I have called out for in the past...you can find many reasonable ideas related to touch-move in an old thread I started:
