Exploiting LM rules?!

I was wondering the same issue. For me the TD or the comitee should always act against the player who tries to take a "smart" advantage of the situation if the rules allow this. Here I am not sure, the Eubgf rules says clearly the match must be restored but this is difficult because matches are not recorded.
I hope this situation can happens less because of poor sportsmanship but a kibitzer can call the TD as it happened in Chicago or the TD can arrive there by chance, should the TD just pointing out and hitting the clock makes the previous moves valid or trying to restore to the previous legal position ?
Otherwise let's figure out in Chicago the TD arrived with still a few seconds on the clock, the decision would have been different ?
