Three players are chouetting and play by 'legal' moves, which means if an illegal play comes up and a player happens to notice it, that person is allowed to speak on it even if there are no cubes turned.

That is not what legal moves means where I come from. If you are playing legal moves and an illegal move is noticed by anyone in the chouette (even if they've been cubed out of the current game) they must point it out. Saying they are 'allowed to' you are suggesting they have the option of not saying anything.
