That is true, and would be why the idea of penalty points would be a last resort if I were ruling.
In this case in particular an error was made but the staff have to also accept the oversight as well (and maybe more so than the players). I would say that
a) Players screwed up by not playing with a clock b) Staff didn't see that no clock was in use at any time during the match c) Staff didn't enforce the maximum time allotted. Personally the maximum time limit (imho) should be enforced by staff not players.
Lets say I ran this event and my staff missed that there was no clock. Okay, that would have been detected at about 75 mins when staff should have checked on the match (When players start a round they should have to write the start time on the drawsheet or some other mechanism). The match should have been called at 75 mins and whatever policy is used in that situation to declare a winner. The penalty in this case is that the match would be called on the spot based on the tournament procedure for that situation.
But staff made two errors, and I think the "not checking around 75 mins" is the biggest of them all. You can put blame on the players but the reason the match wasn't called after 75mins is not because they weren't using clocks, but because no staff stopped the match at that point.
I don't think players should pay for an ovser-sight on the staffs part. With that being said, if I had to reduce the play time of the event without penalizing the players in question, I'd consider the *option* of reducing the match length of all future rounds.
