Let's see if I understand this.

GaryO suggests that, "beyond writing. the funds need to be on deposit (verifiable)."

I suppose that means that the promoter should set up some sort of an escrow account with the guaranteed money placed into it. In this case, that means $100,000.

When, precisely, should the account be created? A reasonable answer might be: before the first promotional material that mentions the guarantee is issued.

If I have this right, then Gary believes Chiva should have rustled up a hundred grand, and left it sitting idle in an escrow account lo these many months. This, in spite of the fact that the shortfall in Punta Cana was "only" $32,500.

OK. I'm not stating an opinion. I just wanted to make sure I understood what Gary was saying.
