This is a judgment call. One can question whether patents of any kind should ever be granted, whether patents in general are a hindrance or not, etc. Patents (in the U.S. at least) expire after 14 to 20 years, unlike copyrights, which are getting close to being infinite. So the amount of hindrance they can cause is limited.

In any case, my point wasn't to argue that all algorithms ought to be patentable. It was to point out that the law is even more self-contradictory than usual on this point, and to explain how it got that way.
