Hello,
It is difficult to say anything without a full picture including at least the full terms and conditions.
I have my doubts about Play65's position, not least because of the difficulties in identifying what are Bonuses in a mixed fund (how do they know what are the bonuses and what your winnings are? It is unlikely to be as simple as "Play65 paid you this bonus 5 years ago and now can reclaim it by refusing to pay you"). In addition, many jurisdictions have clauses about the fairness of consumer contractual clauses.
However, legal rights are only as good as your ability to enforce them - if Play65 has no money then all the legal rights in the world may mean nothing.
As a start, I would suggest you gather the following information:
- A copy of the full terms and conditions including details of what law and jurisdiction cover the full terms and conditions; - Details of who regulates Play65.
I would then think about approaching the regulator for his view of Play65's position. For example, he may say that under the regulatory rules of [X] jurisdiction, all bonuses become the property of the player immediately. Play65 may also have a segregated "customer" account which Play65 cannot remove the funds from in the manner claimed.
If the regulator is not much use, you may wish to think about approaching a law firm specialising in the law applicable to the T&Cs. However, as with all legal advice, you should think about whether you are throwing good money after bad - if you have only lost a couple of hundred dollars, the cost of the legal advice may exceed the money you may (or may not) get back.
