But if the video is in the public domain, then why is the match transcription your intellectual property rather than the intellectual property of someone else who happens to transcribe it?
Response: I had hoped to make a much narrower point to you and did not intend for you to get the impression you did about us giving carte blanche permission for anyone to make transcriptions of videos we own. I acknowledge the question of ‘ownership’ of intellectual property rights of these kinds of videos could be controversial.
Let's presume that the particular video to be transcribed is deemed to be in the public domain. In this instance, I am asserting is that the particular transcription made on our behalf, for purposes of posting on our site, cannot be replicated as presented on our site, because of trademark rights. Since the video is in the public domain, of course that permits anyone else from transcribing it without our permission.
I am also asserting that our transcription agreement with a volunteer, staff, or contractor permits us to deny that person from distributing the transcription work done on our behalf. .
I know enough about intellectual property law that what I have stated above is correct and hope this clarifies my response to Bill.
