I know what you meant, Lenny, or at least I think I do. Please correct me if I'm reading you wrong.
You seem to mean that for all practical purposes, a player who has studied the game more, finds many more moves at the board without using any reserve time figuring them out, has a big advantage over someone who has studied less. That player has to "go into the tank" more often, and so uses up more of his or her reserve earlier in the match, and thus ends up in more danger of timing out.
I also think you don't exactly mean the word "scam" in the legal sense, or the post office warning posters sense. I get the impression that what you meant was more like that the better players have found a way to sneak a bit more skill into the overall composition of luck vs. skill in backgammon tournaments.
And that might be true, but if you poll the players who would in fact be the ones to be hurt by this, many of them will likely tell you (as many have told me) that they prefer using a clock, or at least having the option, to sitting there after midnight while some bozo spins his wheels for five minutes deciding how to play an opening 43 at 4a7a. Fortunately, there aren't too many snails that slow, but they do exist, and the clock does tend to cure them.
