There was a thrown match in Las Vegas not too long ago. The relative strength of the players was the issue, not the side pool. Both contestents involved in the "deal" were disqualified. The "winner" had already gone on and won a semi-final match when the thrown match was discovered by the director. The loser of the semi-final match was reinstated and won the tournament.
Following this example, both players could have been disqualified. As the director mentions, prohibiting the transaction might not have been enforable.
It's tough to know what would be best in this case without knowing all of the circumstances. For example, were the contestents involved seasoned tournament players or not. I would certainly be inclined to do something in an attempt to discourage this anti-competitive action. I would never again attend an event where this was allowed.
