The way I did it in Charlotte, and the way Ken Bame is doing it in San Jose, is a little different. You are not eliminated until your 4th loss. But you cannot finish first with 3 loses. Swiss rounds continue until there is only 1 player with fewer than 2 loses, who is the winner. Players with 3 losses continue playing until the final round, and more wins mean a higher cashing position. I chose a number of wins you needed to finish in the money -- I think it was 7 for the Championship division.

This addresses most of the concern about late round byes, since the bye will always go to a player with 3 loses - never to a player who can still win the whole thing.
