It's clear from the video that Rich wasn't doing anything shady on purpose, and no one -- neither Roberto nor anyone on this thread -- has suggested otherwise.

That's the other problem with a punitive approach to this transgression: it's going to be punishing non-deliberate behavior almost all the time.
