The proper ruling is going to depend on how the rules of that particular tournament are worded so being lazy, I can't give you an answer. I don't want to hunt down the rules. You could have linked them in your original post.
How should it be ruled? This is my opinion only and I realize others will disagree but to me, you haven't officially made a decision until that clock is punched. That's what it's there for. I don't care if you pick the cube up, find 4 other cubes, juggle them around for a few minutes them slam them all back on the board and finally take/pass. I don't budge until you hit the clock. If more people adhered to this we wouldn't have grabby hands over the board after plays. It's such a simple concept I don't get why it's so hard to follow. When your opponent hits the clock it's your turn to do stuff, until he does you do nothing.
As Koca already pointed out, if the opponent thought his opponent took as soon as he put the cube on his side of the board he should have been a good sport and reminded him to hit his clock. Since he didn't I have to believe he didn't think his cube decision was final either, or, he's a dick. Your choice.
For the second scenario where the player gets up and paces. You should not be permitted to do anything that distracts your opponent unless there is a good reason for it. Similar to the opponent incessantly talking to me, beating the table in rhythm with the music they're listening to, whatever, should not be allowed. Perhaps the player has been sitting too long and needs to stretch or has bad circulation or etc.. That player should have moved between games but if for some reason he needs to do it now he should do it out of the view of the other player as it would be quite distracting. The issue with this of course is if that player is away from the table they can't see everything that is going on so in theory they could come back to an altered position and then what!? Then we have a problem. Not something I ever expect to happen but when it does ... then we get more posts on the forums. Pick your poison if you need to get up that badly. Or, ask the opponent for a break in the middle of the game.
