No -- failure to pay a debt is not theft. That's why debtors' prisons were abolished
I don't think this is why debtors' prisons were abolished. They were abolished because by putting the person in jail it was a lose/lose situation. The ppl to whom the money was owed had no way of recouping it because the jailed person had no way of making money since he was...in jail.
People can still be put in jail for debts, just not gambling debts.
A gambling debt is not even legally enforceable
Argumentative. Normally it wasn't 'legally' enforceable because often the act of gambling is seen as illegal itself. This would make a nice thesis and I'm not going into it ... it would be taken on a case by case basis depending on the state and exact "gambling debt" in question. There are too many variables that would have to be defined to come to a conclusion.
