illegally borne off checker rule

In the posted position, the player on roll is in fact eligible to bear off checkers and it was unquestionably his intent to bear off the checker, but I see no ambiguity in the rule....
And I thought Gregg had a temporary circuit disconnect but now I see another rational+reasonable person agrees. (I think Gregg has sinced changed his mind.) Now I'm 100% convinced:
the rule is Fouled Up Beyond All Recognition.
BTW, I'm curious. If this happened in a match you were playing, and assuming the perpetrator (who bore off the checker) was neither a friend nor an enemy of yours, would you accept the legal play and then (if he never bore off any of the remaining 14) accept the gammon?
