If "legal plays" were the rule then consciously not requiring an opponent to correct an illegal move would be in violation of that rule. Therefore, cheating. (Do we all agree on this?)

Obviously unenforceable and undeterminable. There is no way to determine 'consciously' or 'intentionally'.
