Just to be clear. We're not talking about a situation where someone did product research and looked at various top of the line backgammon boards to get a sense of details and features in order to design something unique and even better. We're talking about someone who's goal was to literally copy someone else's board design so that a spectator might not actually know it was a different product and then make some improvements in construction and materials.
Yes, this is legal. But lets say you spent years working hard designing, building and developing a restaraunt and working hard to earn a reputation as being the best, and someone with deep pockets came to your restaraunt and liked what they saw and never spoke to you and just went and opened a whole chain with the identical menu items and identical decor and identical theme and named it something different. Would that be just fine with you?
