I am not a lawyer, nor do I play one on TV. But I do see some clear distinctions in what might or might not be copyrightable content.
Seems to me that there is a fundemental difference between a bot rollout of a match and a creative work. Obviously we are not talking about copying commentary.
If the individual chose specific positions from play or constructed them, and possibly grouped them by theme, and someone else came along and took the same positions in the same order, I suppose someone could pretty clearly argue that their creative work was taken. But if someone just captures and runs an entire match and posts it, what have they really created? Similarly, if someone rolls out the opening positions or creates a bearoff database, these are not carefully chosen positions. Clearly many others have done it before. They are just a brute force enumeration, perhaps throwing away the obvious noise. So no creative work in my opinion.
