You are right. No amount of rule re-writing will help if there is someone who does something deceptive and takes a shot of some kind, or finds a way to abuse the rules to take unfair advantage. In tournaments, we have Directors and committees who can make adjustments when this kind of behavior happens...and they have the right to override the rules in favor of fair play and good sportsmanship.
In chouettes, we do not have a director to "protect" players from abuses...from doing things that are not specifically covered in the rules yet give them an unfair advantage. So when something like this happens, the players, collectively, need to step in and use arguments such as "the accepted customs of the game" etc. and "fair play must prevail" as arguments to cover these kinds of situations.
I have my own standards that says if someone does take an unfair shot or advantage over someone else, it is my responsibility as a participant to speak up even if it doesn't directly involve me, as any shady or unfair behavior truly does involve me if it is allowed to happen in a game that I participate in. I encourage everyone else in the game to have the same standard, and for the most part this works very well.
While we have had plenty of arguments and disagreements over the years, in almost every case I believe it ended with a fair resolution or reasonable compromise, and I don't recall losing players as a result of rule interpretation disagreements. Ever. So I would say this works pretty well.
