Just adding to Tim's comments. If the tournament flier clearly states that video recording is allowed, then players have the choice of entering the tournament and possibly having their matches recorded or not entering the tournament. Then it wouldn't be an infringement. Many contests allow video recording. If you enter the Olypmics, for example, you kinda have to expect the event you're participating in might be recorded.
As a general principle, I think video recording is good for backgammon. Another rule tournaments might consider instituting is that if you record a match you should share the transcript with your opponent, and maybe even with the TD. Wouldn't it be great if it became a tradition for major tournaments to publish, say, the top ten matches of the tournament on CD for $10?
