--- If that decision is made then am I correct that equity has been gained by the players with 3 losses? Instead of splitting 4th, 5th, 6th, there is now a chance for them to move up in to a split for third.

That would not seem fair. According to the rules of the tournament at that point the players with < 3 losses should be 1rst, 2nd, 3rd (with possible ties)and the thee loss players tie for 4th-6th. There is some coincidental bracket consideration that makes you want to break from the rules. I suggest that if the 2 loss player loses to a 3 loss player that his then 3 loss record is considered better than the 3 loss player who had 3 losses already. Everyone still has something to play for: The 3 loss players instead of all being tied would be separated into those with 3 losses and those with 4 and the somewhat arbitrary nature of the decsision does not mess with players' equities.
