It is a legit economics question

How the promote innovation and diffusion of innovation is a very legit question of economics. The usual thinking is that patents (etc) are the way to go, but that is not something that economic theory shows unambiguously. Another issue is that within patent systems, an issue is the strength of the patents (for example, the duration of patent protection).

The problem is that patents solve the issue of incentives for innovation, but by doing so create a distortion (market power, and potential oligopoly / monopoly distortions) and slow down diffusion.

My own take is that it may not be optimal, but works pretty well.
