You are correct. He makes a poor legal move, according to the rules he is out of luck and he should not be given the opportunity to change it. Again, if I did this I would absolutely refuse to allow my opponent to let me change it, if offered, because I was dumb enough to not pay attention or play well, and I deserve the appropriate penalty. I do not believe we players have the right to bend rules on the spot, even "to be nice" as it is not respectful of the game, people who may have bet on us, and people who are affected by the outcome of our match. And again, we are talking about major tournament competition...not friendly games at the local club where we absolutely should cut some slack for new players and beginners until they have gotten comfortable with the rules.
