DQ: Did Magriel ignore the gammon risk?

This position is from Paul Magriel's 12 April 1979 New York Times column. It was apparently adapted from a match position. I don't know if in the resulting problem Jacoby was in use, but since the cube was turned, I assume it does not matter.

Magriel's explanation makes sense to this donkey. However, the article did not discuss the gammon risk, thus I wondered, resulting in the subject question.

Your thoughts please.

The score (after 0 games) is: gnubg 0, Leo 0

Move number 5: Leo to play 51
