I believe that no one is guilty until proven so.
Not commenting on Rod's situation at all, but...
This is one of the most repeatedly misused and misstated concepts. Anyone is guilty of a crime the moment they commit the crime, regardless of whether they are convicted at some later time or not. And even if they are found not guilty (but actually did it), they are STILL guilty of the crime, even though the state doesn't exact any punishment.
'Presumed innocent until proven guilty' is a concept that applies in courtrooms, and dictates the process of the prosecution, defense and the deliberations of the jury. It has nothing to do with the actual guilt or innocence of the accused. And the proper phrase is 'PRESUMED innocent until proven guilty', not 'Innocent until proven guilty'.
Again, I have no knowledge or opinion on the actual facts of Rod's situation.
