It seems fair that the initial offender should not be allowed to benefit from breaching the rule, so if 2a recubes 4a then the trailer must take and play on for match, but may not drop and lose the match. In this way the leader can be punished for his error but cannot gain an advantage from it, as with premature rolling or failure to lift a hit checker. As Phil says, the rules of no other game or sport protect a player from his own folly.
We should not need rules to tell us that a turned cube becomes dead at 2a 2a, though the real world demands that everything be defined and addressed as best as practicable with TDs and committees to fill the gaps. But it is called a dead cube for a reason and should remain dead for the rest of the match, not just until one player decides to use it; otherwise there is nothing to stop a player from cubing at DMP.
It may be worth considering where we end up if a player drops a cube without realising it is legally dead, and then loses the position whilst setting up the board for the next game. With the risk of going in several directions all at once, should he be penalised for responding hastily to an illegal action by his opponent? If so, this would seem to legitimise opportunism if not outright gamesmanship.
