You can sue anyone. The question is can you collect?
I have found that the threat of legal action is often the best alternative. A letter from an attorney saying that you will take action if they don't protect players from cheaters and if they don't make restitution to you might be more effective than actually filing a suit.
Whoever you sue might be impossible to collect from even if you ever do get the suit properly filed.
Another thing you can do is threaten to expose them by letting the world know that there are cheaters on their site and they don't do anything about that. Then, of course, they might sue you!
