If you are referring to the well documented case (on this forum) of some of the baffle boxes in use at the old Cavendish West Club in the mid to late '80s, how do you know that they were fraudulently made? To quote Joe Russell in a famous post in 2009:
"The baffle boxes were old and not in the greatest condition and some of the boxes were less baffled than others. Some were home-made. The 'skilled' rollers would actually seek out a less baffled box..."
This does not mean of itself that it was the cheats who designed them, merely that they exploited them (without cups).
In the absence of many thousands of carefully controlled trials, would not applying commonsense be a suitable alternative? Most baffle boxes now in use clearly help greatly in the approach to randomness, realising of course that true randomness can - in theory at least - never quite be attained. Having the default that (unless both players agree otherwise therefore) cups must be used in conjunction with the box - as per the current USBGF Rules - this adds a second layer to the process, which may help anyone feel more at ease who has any doubts (reasonable or otherwise) about using a particular baffle box without cups.
