The issue is that currently there is no general policy in the US. (I see from Richard's post that Howard had made one for this tourney -- openly? -- at the end of the Calcutta. And from your post he backed this up when called.)
Historically (maybe not back to to the Pleistocene, though :) if a player objected to recording, his objection was honored by director.
A good habit to develop (and yes, much easier said than done) is to dismiss/ignore/erase comments from opp that aren't blatantly vicious (i.e. what you experienced in Novi should not be ignored). If the guy ALWAYS asked permission, good for him; now let's play BG. Same when he asked you about being too serious. (Apparently you did just what I recommend -- ignore him.)
I've noticed that many people who are used to (intentionally or not) putting opp on tilt by their comments are themselves thrown off kilter when they are simply ignored. But either way, the better you can focus&concentrate, the better you will perform.
