A starting point for me would be to minimise the maximal individual difference over all players between their equity in a standard reasonable format, eg. cup with distribution of byes and seeding in the first round done by rating, and in any format under consideration.

I guess it depends on the objectives for the tournament!
No. For a single individual event, fairness of the format does not depend on why it was chosen. You choose an unfair format giving higher rated players an artificial added advantage in order to increase the likelihood of having high rated players succeed in the tournament. This of course does not make the format fair.

It seems a format like this is mainly a result of some people having a hard time accepting the nature of the game.

Using potential less unfairness to some compared with earlier formats is not likely to change anyones opinion.
