A settlement can really happen at any time, in any cube state or situation -- you could even roll the dice and offer to play it a certain way if your opponent would dial back the cube! Both players just have to agree to the terms. Any settlement can be declined, since by playing a game with mutually accepted rules and an agreed-upon stake, one player doesn't get to impose a different settlement on his opponent.
Most commonly, settlements come up after one player has completed his current play, and having the next roll automatically revealed would undercut the opportunity to offer a settlement -- say the player on roll is in a last-roll scenario where he has 17 winning numbers and his opponent holds a 32-cube. If the Buddy auto-rolls immediately after the opponent makes his play, the game is decided before they can talk about a fair settlement, which in that case would be for the underdog to pay 19/36 - 17/36 = 2/36 of 32cube = 1.77 points. Typically the roller might say, slightly generously "I'll pay you 2" or the other guy might say, on the greedy side, "I'll take 6".
Settlements aren't technically allowed in tournament play, as far as I understand.
