Technically the answer seems clear. However...

That one's is easy for me. If he's my friend then he's honest. I simply ask him if he was hitting all along and just forgot to pick up the checker in time or did he not see the hit (or saw it initially and by some brain freeze FORGET that he could hit) and make the non-hitting play -- meaning his intent while picking up the dice was no-hit. I trust his answer and that's how we proceed.
Something related occurred in Madison when I tapped "en passant" (and maybe moved -- I can't remember to minute detail) Rob Maier's blot and then in my rush to punch the clock failed to put the checker on the bar. Rob simply put it there for me after his clock started.
If I don't know the person well enough, then it's a different matter.
Why not do the same in your chouette? If you can't trust him here, why is he in your chou in the first place?
