If we want to discuss how the existing rule should be interpreted, I think we're in agreement that it's confusing.

If we were working from a blank slate and talking about how to handle the issue, it seems fair to me that a player should be able to point out an illegal play at any point before he rolls or doubles, since he hasn't gained an advantage, and it's easy to imagine a player who reflexively picks up the dice and then realizes there's something wrong. But of course he ought to be at a disadvantage if there's a dispute as to what the roll was.
